Perfect For Foreigners Who Want To Invest In US Tax Liens

One of the obstacles that foreigners have when investing in tax liens here in the United States is they have to have U.S. tax ID number and a U.S. bank account. Getting these things is not as easy as it once was. Now in order to get an Individual Tax ID Number (ITIN) from the IRS, you first have to form a U.S. business identity and get an Employer Identification Number (EIN) and then file a U.S. tax return. This entire process could take months, and then you have to pay an agent here in the U.S. to receive all of your business mail on an ongoing basis. But when you invest in a private fund, you are personally buying shares in a U.S. LLC and can avoid some of the hassle. You also don’t need to set up a bank account in the U.S. in order to invest.

Get A Leg Up On The Competition!

Investing through a fund gives you an advantage over other investors. I don’t know if you’ve noticed this but the competition is getting tougher for the individual investor at tax sales. The institutional buyers definitely have the upper hand. When you invest through a fund, the fund has advantages that you don’t have as an individual and they have a better chance of winning bids on liens at the tax sale. Bidding at a county sale on your own, you’re lucky if you come away with a handful of properties at single digit interest rates, but fund companies typically win hundreds, even thousands of bids and at better rates. There are a couple of reasons for this, one is that they have professionals doing the due diligence for them and they can pick out the commercial properties and vacant land parcels that individuals might stay away from. The other reason is that they typically can have a lot more bids on properties due to the many individual tax numbers that they can register with at the tax sale.

There Is One Caveat Though

There is one caveat, investing in a tax lien investing fund is not for everyone. You can start investing in tax liens with only a couple of thousand or even only a couple of hundred dollars, but you can’t start that small if you are investing in a fund. The private fund that I’ve invested in now has a minimum investment of $25,000. Other funds that I know about have minimum investment amounts of $50,000 or $100,000. And your money is tied up in the fund for about 6 years, so it’s not a liquid investment.

And you cannot just invest in this fund any time you want. This investment company only opens a new fund once a year. Each fund has a 2.5 million dollar cap, and once they reach this number the fund is closed to new investors. They opened a new fund last November and thought that they would reach their subscription quota and close the fund in April in time for the Florida tax lien sales in May. But they actually reached it by the end of the following month and were ready for the Arizona tax sales in February. The good news is that they’ve just opened another fund.
